Recitals
A. As used in this Agreement, EBCC includes its officers, officials, agents, employees, and volunteers.
B. As used in this Agreement, "premises" and "facilities" includes all leased facilities and common areas, including but not limited to parking facilities, restrooms, walkways, hallways, etc.
The parties hereby agree as follows:
1. Renter will be responsible for and will pay for any damage to EBCC property arising out of the use of the said facility pursuant to this Agreement. No EBCC equipment or property shall be removed from premises.
2. The EBCC does not assume any liability for property lost or stolen on the EBCC premises, or for personal injuries sustained on the premises during renter's use of the premises regardless of the severity of the injury. Renter further agrees to waive and release the EBCC from any and all losses, claims, suits or judgments or damages that renter might sustain as a result of any and all activities connected with or associated with this Agreement.
3. No drugs, beer, liquor, or any alcoholic beverages shall be brought or consumed upon the premises or be in the possession of any of Renter's guests, invitees, employees, or agents.
4. No weapons of any kind shall be brought upon the premises or be in the possession of any of Renter's guests, invitees, employees, or agents.
5. Renter shall be responsible for inspecting the facility subject to this Agreement prior to each use and shall be responsible for bringing to the EBCC's attention any potential dangers, safety hazards or problems. Renter is solely responsible for determining whether said facility is safe, appropriate, and/or compatible for Renter's intended use.
6. Renter certifies that their use of the premises is permitted under the Illinois Governor's Executive Order and that Renter will comply with the Illinois Department of Commerce & Economic Opportunity published guidelines for conducting Renter's specific intended uses.
7. Renter is solely responsible for providing any and all supervision at all times during Renter's use of any facility and all common areas. Further, Renter shall be responsible for ensuring that Renter's guests and invitees comply with all applicable rules and regulations pertaining to use of EBCC facilities. Renter shall not permit any area to be used for any disorderly or unlawful purposes during the period of this Agreement.
8. Either party hereto may cancel this Agreement by delivery of written notice to the other party at least one (1) week prior to the scheduled hour as designated. If Renter is not paying for use of the facility, notice may be given at least 24 hours prior to the scheduled time.
9. It is fully understood and agreed by the parties that the Renter shall defend, indemnify, and hold harmless the EBCC, its trustees, officers, employees, volunteers, and agents against any and all liabilities, claims, damages, losses, costs and expenses (including reasonable attorneys' fees) arising indirectly or directly in connection with or under, or as a result of this Agreement.
10. Renter agrees that the EBCC cannot guarantee that Renter's guests and invitees, or others with whom they come into contact, during and after participation in Renter's use of the premises, will not become infected with a communicable disease, including COVID-19. Renter certifies that they understand and agree it is Renter's responsibility to communicate any and all communicable disease (ex. COVID-19) warnings and notices to Renter's guests and invitees.
11. This Agreement is entered into solely for the benefit of the contracting parties, and nothing in this Agreement is intended, either expressly or impliedly, to provide any right or benefit of any kind whatsoever to any person or entity who is not a party to this Agreement, or to acknowledge, establish or impose any legal duty to any third party.
12. This Agreement represents the entire understanding between the parties. This Agreement may be modified or altered only by further agreement in writing between the parties.
13. Interpretation of this Agreement shall be governed by the laws of the State of Illinois.
14. Renter understands that they are responsible for cleaning up the area used and taking out trash.
15. Renter understands that security deposit will be returned within 10 business days after the event, in form of check, minus any costs for cleaning, damages, or breach of agreement rules.
16. Renter understands that rental time includes set-up and cleanup, and that cleanup should begin no less than 30 minutes prior to the end of the rental time.
17. If renter will have a bouncy house or similar activity, renter understands that it must come from a licensed business with liability insurance to cover any possible damage or injury.
18. If event will have attendance of over 80 people, renter understands that they must pay an additional fee to contract an off- duty police officer to be present for the entirety of the event.
19. Cancellation policy is as follows: 100% refund if event is cancelled 20+ days before event; 50% refund if event is cancelled 5-19 days before event, 0% refund if cancelled fewer than 5 days before event.
20. Renter agrees that they must know their guests and that no open invitations via social media are allowed. This will result in immediate cancellation of the event according to the cancellation policy above.
21. All agreements must be paid in full two weeks in advance of the event date or event will be cancelled.
